General Snaply terms and conditions.
Please read these Terms and Conditions carefully before using the services of Snaply. By engaging our services, you acknowledge and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our services.
1. Services:
Snaply provides professional real estate photography services, including but not limited to property photography, videography, virtual tours, and related services. The specific services provided will be outlined in the agreement or contract between Snaply and the client.
2. Client Responsibilities:
The client agrees to provide accurate and complete information regarding the property to be photographed. This includes the property address, property type, square footage, and any specific requirements or instructions for the photo shoot.
The client is responsible for ensuring that the property is adequately prepared and staged prior to the scheduled appointment. This includes decluttering, cleaning, and arranging furniture or decor to showcase the property in the best possible manner. A reshoot fee may apply if the property is not ready at the time of the scheduled shoot.
3. Pricing and Payment:
The pricing for Snaply's services will be communicated to the client either through a price list, quote, or contract. All prices are in the currency specified.
Payment must be made prior to the delivery of the final products. Alternative payment terms must be arranged in advance. Snaply reserves the right to withhold delivery of the final photographs or other deliverables until payment has been received in full.
4. Intellectual Property:
Snaply retains all copyright and intellectual property rights to the photographs and other deliverables created during the provision of services. The client is granted a limited, perpetual license to use the photographs in any manner they choose (other than reselling) including but not limited to: use in MLS, use on other listing websites, broker websites, personal websites, social media sites
The client may not sell or sublicense without prior written consent from Snaply. Snaply may use the photographs for promotional purposes, including on its website or social media platforms, unless otherwise agreed upon in writing.
5. Limitation of Liability:
Snaply's liability for any direct damages arising out of or in connection with the services provided shall be limited to the price paid by the client for the specific order. Snaply shall not be liable for any indirect, incidental, consequential, or punitive damages.
Client acknowledges that Snaply engages independent contractors to capture the photos on site. Snaply is not liable for the actions of the independent contractors.
6. Confidentiality:
Snaply will treat all client information and details related to the services provided as confidential and will not disclose such information to third parties, except as required by law or with the client's consent.
7. Governing Law and Jurisdiction:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Colorado, United States. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Colorado.
These Terms and Conditions constitute the entire agreement between Snaply and the client and supersede any prior agreements or understandings, whether oral or written, relating to the services provided.
9. Amendments:
Snaply reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on Snaply's website or providing notice to the client.
